Step-by-Step Trademark Registration Process

Step 1: Trademark Search (Optional but Recommended)

Before filing, a search is conducted to check if a similar or identical trademark is already registered or pending.

🟢Purpose: Minimize risk of rejection or opposition.

➡️Conducted by: DPDT or through NEXORA IP’s expert services


Step 2: Filing of Application

File a Form TM-1 with the required details:

  • Trademark logo or wordmark
  • Name, address, and nationality of the applicant
  • Description of goods/services (according to NICE Classification)
  • Priority Claim if remain (Priority Number and Date, Country with supported document)
  • Power of Attorney

Step 3: Examination by DPDT

The Examiner(AD) examines the application for:

  • Distinctiveness
  • Conflict with existing marks
  • Compliance with the law

🕒Timeline: 4–6 months (may vary)

Possible Outcomes of Examination:

  • Accepted: If the examiner finds no issues, the application is accepted and proceeds to the publication in the Trademarks Journal.
  • Objection: If any issues are found, the examiner issues an Examination Report raising objections. A response must be submitted within 30 days from the date of issuing the report.
  • ➤our expert legal team specializes in drafting effective responses to overcome objections and ensure smooth processing.
  • Rejection: If the reply is not satisfactory or the mark is deemed non-registrable, the application may be rejected.
  • ➤In such cases, an appeal can be filed before the appropriate authority.

Step 4: Publication in Trademarks Journal

If accepted, the mark is published in the Trademarks Journal for third party opposition.

🕒Opposition Period: 60 days from publication

➡️ Any third party may file opposition via Form TM-5

➡️ NEXORA IP handles opposition defense if requires.


Step 5: Registration Certificate

If no opposition is filed or opposition is resolved in your favor, the Director General issues a Registration Certificate.

🕒Timeline: 2–3 months after submission of certificate fees.

The trademark is valid for 7 years from the filing date or priority date as the case may be.


Step 6: Renewal of Trademark

Trademark can be renewed for subsequent periods of 10 years each by filing Form TM-12 and may be continued for an indefinite time.
