Step-by-Step Trademark Opposition Procedure in Bangladesh

Step 1: Publication in Trademarks Journal

Once a trademark is accepted by the DPDT, it is published in the official journal for public notice.

➡️ Any interested party (individual or company) can file an opposition.


Step 2: Filing Notice of Opposition (Form TM-5)

The opponent must file a Notice of Opposition using Form TM-5 within 60 days of the journal publication.

📝 The notice must include:

  • Details of the opponent and the opposed mark
  • Grounds of opposition
  • Supporting documents and evidence (if any)

Step 3: Service of Opposition to Applicant

The DPDT serves a copy of the opposition notice to the trademark applicant.

🕒 The applicant has 2 months to respond.


Step 4: Filing of Counter-Statement (Form TM-6)

The applicant must file a Counter-Statement using Form TM-6 within 2 months of receiving the opposition.

➡️ Failure to respond means the application is deemed abandoned.


Step 5: Evidence Submission by Both Parties

  • Opponent’s Evidence: Filed in support of opposition
  • Applicant’s Evidence: Filed in defense of application
  • Rebuttal Evidence: Optional final round for the opponent

➡️ All evidence is typically submitted as affidavits and supporting documents.


Step 6: Hearing

After review of all documents, the DPDT may:

  • Call both parties for a hearing, or
  • Decide the matter based on written submissions

👨‍⚖️ The Registrar will give a decision to either:

  • Reject the trademark, or
  • Allow the trademark to proceed to registration

Step 7: Appeal (if needed)

Any aggrieved party may appeal the Registrar's decision to the High Court Division of the Supreme Court of Bangladesh within the specified time.
